ISO 9001:2000 Investment Procedures
Registration For Amendment Of Investment Certificate (QT7.0/TTXT-06)
Applicable to projects which after amendment of objectives, scale, location, capital, form, or duration fall into the following categories: foreign investment projects which, upon amendment, have an invested capital of below 300 billion VND and are not included in sectors in which investment is conditional; domestic investment projects which, upon amendment, are not in sectors in which investment is conditional, except for the cases stipulated in Clause 3 of Article 51 of Decree 108/2006/ND-CP - implemented in Binh Dinh Province, except investment projects in industrial zone or economic zone
File to submit: 02 sets, including at least 01 original set, comprising:
1. Registration/request for amendment of Investment Certificate on standard form:
- For cases where Investment Certificate is not associated with establishment of enterprise or branch: Appendix I-4;
- For cases where Investment Certificate is associated with establishment of branch: Appendix I-5;
- For cases where Investment Certificate is associated with establishment of enterprise: Appendix I-6;
- For cases of amendment of only contents of business registration or operational registration of branch in Investment Certificate: Appendix I-7;
- For enterprises with foreign invested capital or parties to business cooperation contract issued with Investment Licence prior to 1 July 2006 which have not yet re-registered and which do not re-register): Appendix I-16
2. Attached documents comprising:
- Copy of Investment Certificate, amended Investment Certificate, Investment Licence, and Certificate of amendment of Investment Licence;
- Amended joint venture contract: Applicable in cases of amendment of an Investment Certificate with changes in the contents in the signed joint venture contract;
- Amended business co-operation contract: Applicable in cases of amendment of an Investment Certificate with changes in the contents of the signed business cooperation contract;
- Draft amended charter of the enterprise, List of members or founding shareholders: Applicable in cases of amendment of an Investment Certificate with changes in the contents of the charter of the enterprise or addition of additional members.
File receiving body:
Processing time-limit: Within 06 working days from the date of receipt of valid file.
Fee: Free of charge for amendment of Investment Certificate only; 20,000 VND for cases of amendment of only contents of business registration or operational registration of branch in Investment Certificate.
Evaluation For Amendment Of Investment Certificate (QT7.0/TTXT-07)
Applicable to projects with foreign invested capital which after amendment fall into the category of evaluation for issuance of an Investment Certificate and amended items do not relate to sectors in which investment is conditional, and investment projects which after amendment are not under the approval authority of the Prime Minister of the Government - implemented in Binh Dinh Province, except investment projects in industrial zone or economic zone
File to submit: 08 sets, including at least 01 original set, comprising:
1. Registration/request for amendment of Investment Certificate on standard form:
- For cases where Investment Certificate is not associated with establishment of enterprise or branch: Appendix I-4;
- For cases where Investment Certificate is associated with establishment of branch: Appendix I-5;
- For cases where Investment Certificate is associated with establishment of enterprise: Appendix I-6;
- For cases of amendment of only contents of business registration or operational registration of branch in Investment Certificate: Appendix I-7;
- For enterprises with foreign invested capital or parties to business cooperation contract issued with Investment Licence prior to 1 July 2006 which have not yet re-registered and which do not re-register): Appendix I-16
2. Attached documents comprising:
- Explanation of the reasons for the amendment; changes compared with contents evaluated upon issuance of Investment Certificate (Explanation of the amended contents and the reasons for the amendments);
- Report on status of implementation of the project at the time of amendment of the project;
- Copy of Investment Certificate, amended Investment Certificate, Investment Licence, and Certificate of amendment of Investment Licence;
- Amended joint venture contract: Applicable in cases of amendment of an Investment Certificate with changes in the contents in the signed joint venture contract;
- Amended business co-operation contract: Applicable in cases of amendment of an Investment Certificate with changes in the contents of the signed business cooperation contract;
- Draft amended charter of the enterprise, List of members or founding shareholders: Applicable in cases of amendment of an Investment Certificate with changes in the contents of the charter of the enterprise or addition of additional members.

Evaluation For Amendment Of Investment Certificate (QT7.0/TTXT-08)
Applicable to projects with foreign invested capital or domestic investment projects which after amendment fall into the category of evaluation for issuance of an Investment Certificate and amended items relate to sectors in which investment is conditional - implemented in Binh Dinh Province, except investment projects in industrial zone or economic zone
File to submit: 08 sets, including at least 01 original set, comprising:
1. Registration/request for amendment of Investment Certificate on standard form:
- For cases where Investment Certificate is not associated with establishment of enterprise or branch: Appendix I-4;
- For cases where Investment Certificate is associated with establishment of branch: Appendix I-5;
- For cases where Investment Certificate is associated with establishment of enterprise: Appendix I-6;
- For cases of amendment of only contents of business registration or operational registration of branch in Investment Certificate: Appendix I-7;

Evaluation For Amendment Of Investment Certificate (QT7.0/TTXT-09)
Applicable to projects which after amendment fall under the approval authority of the Prime Minister of the Government but are not yet included in the master plan or are in sectors subject to conditions but for which investment conditions have not yet been stipulated by law - implemented in Binh Dinh Province, except investment projects in industrial zone or economic zone
File to submit: 10 sets, including at least 01 original set, comprising:
1. Registration/request for amendment of Investment Certificate on standard form:
- For cases where Investment Certificate is not associated with establishment of enterprise or branch: Appendix I-4;
- For cases where Investment Certificate is associated with establishment of branch: Appendix I-5;
- For cases where Investment Certificate is associated with establishment of enterprise: Appendix I-6;
- For cases of amendment of only contents of business registration or operational registration of branch in Investment Certificate: Appendix I-7;
- For enterprises with foreign invested capital or parties to business cooperation contract issued with Investment Licence prior to 1 July 2006 which have not yet re-registered and which do not re-register): Appendix I-16
2. Attached documents comprising:

Processing time-limit: Within 36 working days from the date of receipt of valid file.
Fee: Free of charge for amendment of Investment Certificate only; 20,000 VND for cases of amendment of only contents of business registration or operational registration of branch in Investment Certificate.
Language to be used in files for investment procedures
The files of an investment project and official correspondence with the State bodies of Vietnam shall be prepared in Vietnamese in the case of domestic investment projects; and in the case of projects with foreign invested capital, they shall be prepared in Vietnamese or in Vietnamese and a commonly used foreign language. If there is any difference between the Vietnamese language version of a document and the foreign language version, the Vietnamese version shall be applied.
