Registration For Issuance Of Investment Certificate (QT7.0/TTXT-02)
Applicable to domestic investment projects with invested capital of between 15 billion VND and less than 300 billion VND, foreign invested projects with invested capital of below 300 billion VND, all not included in sectors in which investment is conditional and not under the approval authority of the Prime Minister of the Government - implemented in Binh Dinh Province, except investment projects in industrial zone or economic zone
File to submit: 02 sets, including at least 01 original set, comprising:
1. Registration/request for issuance of Investment Certificate on standard form:
- For cases not associated with establishment of enterprise or branch: Appendix I-1;
- For cases associated with establishment of branch: Appendix I-2;
- For cases associated with establishment of enterprise: Appendix I-3.
2. Attached documents comprising:
- Valid copy of the ID card, passport or other personal identification document; copy of the establishment decision, business registration certificate or other equivalent document of the organization;
- Power of attorney together with ID card, passport or other personal identification document of the representative;
- Report on financial capacity of the investor (which the investor shall prepare and for which the investor shall be liable), except for domestic investment project;
- Either of the following documents in relation to land use (for projects which use land): written approval on location or land lease policy of the Provincial People's Committee or the management board of the industrial complex or industrial location, or land rent contract, or land use right certificate;
- Business co-operation contract (in cases of investment in the form of a business co-operation contract);
- Document certifying legal capital (applicable to business lines which are subject by law to legal capital requirements;
- Valid copy of practising certificate (applicable in cases of conducting business in business lines which are required by law to have a practising certificate);
- More documents to submit for cases associated with establishment of enterprise:
+ Joint venture contract (applicable in cases of establishment of joint venture economic organization with foreign investor;
- Draft charter of the enterprise;
+ List of members (applicable in cases of establishment of limited liability company with 2 or more members), or list of founding members (applicable in cases of establishment of partnership), or list of founding shareholders (applicable in cases of establishment of shareholding company);
+ Written agreement or valid contract in relation to the location of the enterprise's head office.
- More documents to submit for cases associated with establishment of branch:
+ Copy of the Business Registration Certificate or Investment Certificate of the enterprise;
+ Copy of the charter of the company in the case of limited liability companies, shareholding companies and partnerships;
+ Written decision together with minutes of meeting on establishment of the branch or representative office of the members' council in the case of a limited liability company with two or more members, of the company owner or members' council or company chairman in the case of an one member limited liability company, of the board of management in the case of a shareholding company, and of the partners in the case of a partnership;
+ Valid copy of the decision appointing the person who will act as the head of the branch;
+ Written agreement or valid contract in relation to the location of the branch;
+ For branches conducting lines of business for which a practising certificate is required by law, there must also be a valid copy of the practising certificate of the head or deputy head of the branch.
File receiving body:
Processing time-limit: Within 06 working days from the date of receipt of valid file.
Fee: Free of charge for issuance of Investment Certificate only; 100,000 VND for issuance of Investment Certificate associated with establishment of enterprise, 20,000 VND for issuance of Investment Certificate associated with establishment of branch.
Evaluation For Issuance Of Investment Certificate (QT7.0/TTXT-03)
Applicable to investment projects with invested capital of 300 billion VND or more, not included in sectors in which investment is conditional and not under the approval authority of the Prime Minister of the Government - implemented in Binh Dinh Province, except investment projects in industrial zone or economic zone
File to submit: 08 sets, including at least 01 original set, comprising:
1. Registration/request for issuance of Investment Certificate on standard form:
- For cases not associated with establishment of enterprise or branch: Appendix I-1;
- For cases associated with establishment of branch: Appendix I-2;
- For cases associated with establishment of enterprise: Appendix I-3.
2. Attached documents comprising:
- Valid copy of the ID card, passport or other personal identification document; copy of the establishment decision, business registration certificate or other equivalent document of the organization;

Fee: Free of charge for issuance of Investment Certificate only; 100,000 VND for issuance of Investment Certificate associated with establishment of enterprise, 20,000 VND for issuance of Investment Certificate associated with establishment of branch.
Evaluation For Issuance Of Investment Certificate (QT7.0/TTXT-04)
Applicable to investment projects included in sectors in which investment is conditional stipulated in Article 29 of the Law on Investment and Appendix III of the Decree No. 108/2006/ND-CP - implemented in Binh Dinh Province, except investment projects in industrial zone or economic zone
File to submit: 08 sets, including at least 01 original set, comprising:
1. Registration/request for issuance of Investment Certificate on standard form:
- For cases not associated with establishment of enterprise or branch: Appendix I-1;
- For cases associated with establishment of branch: Appendix I-2;
- For cases associated with establishment of enterprise: Appendix I-3.
2. Attached documents comprising:
- Valid copy of the ID card, passport or other personal identification document; copy of the establishment decision, business registration certificate or other equivalent document of the organization;

- More documents to submit for cases associated with establishment of enterprise:
+ Joint venture contract (applicable in cases of establishment of joint venture economic organization with foreign investor;

Evaluation For Issuance Of Investment Certificate (QT7.0/TTXT-05)
Applicable to investment projects for which the Prime Minister of the Government shall approve the investment policy stipulated in Article 37 of the Law on Investment - implemented in
File to submit: 10 sets, including at least 01 original set, comprising:
1. Registration/request for issuance of Investment Certificate on standard form:
- For cases not associated with establishment of enterprise or branch: Appendix I-1;
- For cases associated with establishment of branch: Appendix I-2;
- For cases associated with establishment of enterprise: Appendix I-3.
2. Attached documents comprising:
- Valid copy of the ID card, passport or other personal identification document; copy of the establishment decision, business registration certificate or other equivalent document of the organization;
- Power of attorney together with ID card, passport or other personal identification document of the representative;

Language to be used in files for investment procedures
The files of an investment project and official correspondence with the State bodies of Vietnam shall be prepared in Vietnamese in the case of domestic investment projects; and in the case of projects with foreign invested capital, they shall be prepared in Vietnamese or in Vietnamese and a commonly used foreign language. If there is any difference between the Vietnamese language version of a document and the foreign language version, the Vietnamese version shall be applied.
